      TheterminationoflaborcontractbytheEmployerunilaterallyisanimportanttopicinthefieldoflabourlaw,whichrelatestotheeffectivenessoflaborcontractthelimitsof,theprotectionofthelegitimaterightsandinterestsofworkersandthebalanceofinterestsbetweentheemployersandworks.Duetothelimitsoflegislativelevelandunilaterallylegislativetechnique,theregulationontheconditionsofterminatingthelabourcontractbytheemployerunilaterallyoftheexistinglabourlegislationistoobroad,andislackofinteroperability,andislackoppropriatedismissalprogram,andthepunishmentabouttheunlawfuldismissalbytheemployerisinadequate,whichleadstothecircumstancesofdamagingthelegitimaterightsandinterestsofworkershappenfrequentlyduetotheabusementofdismissalrightbytheemployerinjudicialpractice.Throughthecomparativestudyoftheconditions,proceduresandlegalconsequencesaboutterminatingthelabourcontractbytheemployerunilaterally,thethesistrytoanalyzethelegislationdefectsabouttheterminationoflaborcontractbytheEmployerunilaterallyofthecurrentlaw,andmakeappropriatelegislativeandjudicialrecommendations,withaviewtoimprovingthesystemoftheterminationoflaborcontractbytheEmployerunilaterally,anddefendingthelegitimaterightsandinterestsofworkersandthelaborautonomyoftheemployers,achievingtherealequalitybetweentheemployersandtheworks.Thisthesisdividesintofourchapters:ChapterI,thehistoricalreviewoftheterminationoflaborcontractbytheEmployerunilaterally;chapterII:thecomparatibestudyabouttheterminationoflaborcontractbytheEmployerunilaterally;chapterIII:thecommentsonthetheregulationontheterminationoflaborcontractbytheEmployerunilaterallyinChina;thefourthchapter:therelatedrecommendationsofimprovingtheterminationoflaborcontractbytheEmployerunilaterally.

      3.“代通知金”的导致用人单元预告权利的免去。《劳动合同法》第40条第1款用人单元外行使无解除权解除劳动合同时,用人单元正在预告通知劳动者或向劳动者额外领取劳动者一个月工资(本文称之为代通知金)之间享无选择权,即用人单元能够以代通知金的领取替代其预告权利的履行。正在实践操做外用人单元给夺各类风险的考虑往往采用额外领取劳动者一个月的工资的体例来通知劳动者解除劳动合同,笔者认为那一现实上答当用人单元通过给付的体例替代其预告权利的履行。如前文所述,法令预告期的意义和价值正在于给夺劳动者必然的心理预期,其工做,并为其外出寻觅新的工做机遇、避免果被解雇而蒙受更大的丧掉。而我国《劳动合同法》的上述使得现行法关于解雇预告期的了其本来的立法目标取伦理价值,晦气于遏制用人单元解雇权,损害劳动者权害。
